By accessing or using Swapus ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Eligibility

To use Swapus, you must:

  • Be at least 18 years of age
  • Be currently enrolled as a student at an accredited college or university
  • Have a valid .edu email address for verification purposes
  • Have the legal capacity to enter into binding agreements

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must notify us immediately of any unauthorized use of your account.

4. Community Guidelines

We are committed to maintaining a safe and respectful community. You agree to:

  • Treat all users with respect and courtesy
  • Provide accurate and honest information in your listings
  • Communicate professionally with other users
  • Complete transactions in good faith
  • Report any suspicious or inappropriate behavior

5. Prohibited Items and Conduct

The following are strictly prohibited on Swapus:

  • Illegal Items: Drugs, controlled substances, weapons, stolen goods, or any items prohibited by law
  • Alcohol and Tobacco: Alcoholic beverages, tobacco products, vaping devices, or related items
  • Counterfeit Goods: Fake or unauthorized replicas of branded products
  • Hazardous Materials: Explosives, chemicals, or other dangerous substances
  • Adult Content: Explicit or sexually suggestive materials
  • Services: Personal services, academic work, or anything that violates academic integrity
  • Harassment: Bullying, threatening, or harassing other users
  • Spam: Unsolicited messages, fake listings, or promotional content

6. Listings and Transactions

Swapus is a platform that connects buyers and sellers. We do not take ownership of items, handle payments, or guarantee transactions. All transactions are conducted directly between users at their own risk. You are solely responsible for the accuracy of your listings, the condition of items sold, and the completion of transactions. We recommend meeting in safe, public locations on campus.

7. Intellectual Property

The Swapus app, including its design, features, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our app without our written permission. By posting content on Swapus, you grant us a non-exclusive license to use, display, and distribute that content within our platform.

8. Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms of Service, our Community Guidelines, or for any conduct that we determine to be harmful to our community. You may also delete your account at any time through the app settings. Upon termination, your access to the app will be revoked and your listings will be removed.

9. Disclaimer of Warranties

Swapus is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or completely secure. We are not responsible for the conduct of users, the quality of items listed, or the outcome of any transactions.

10. Limitation of Liability

To the maximum extent permitted by law, Swapus and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app. Our total liability shall not exceed the amount you paid to us in the past twelve months, if any.

11. Indemnification

You agree to indemnify and hold harmless Swapus, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the app, your violation of these terms, or your violation of any rights of another.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located within the United States.
